B.S! fired-withholding months pay+

 This cant be legal. absolutely ridiculous.
 i was fired a month ago and today being my last day. i received this letter from a recruitor. 'C' her partner(K) is another recruitor. He also didnt pay me for last month. He paid me 193,000won a month and 'T'  paid 2.1mill. So strange eh? I placed the details in bold.

 I worked there for five months and they say they will withhold my whole months pay not to omention 200,000won from last month.

 There have got to be laws that prevent this. Her letter to me below.

I needed time to figure out what's going on and also am confused what my resonsibilities are like.
 
Anyway, Mr. C asked T school to hold your final pay because you're deliberately terminating this contract within 6 months.
 
In this situation, why your terminating is called "deliberating" is you haven't showed any sign of change at work even though you have been warned several times for correction.
 
Since it was very important for you to cooperate with your coworkers to keep this job, you overlooked it intentionally and the school assumed that you have no willingness to continue the job.
 
Also, when it comes to the accomodation, it's provided by the employer not by your choice.
 
Therefore, Mr. C  doesn't have the duty for your current apartment.
 
Right now, you owe him this month salary for the reimbursement.
 
This is the list of the details.
 
1. housing - 0.48 mil. (Jun.20 - Jul.31)
2. Visarun - 0.32 mil.
3. Replacement - 0.4 mil. 
4. Recruiting - 1.1 mil.

You had better check your contract.  A lot of contracts state that if you leave (or are fired) before 6 months then you have to pay back that the airfare and sometime the recruiting fee.

If you were living in the employers apartment and nor working then it's probably a fair enough deduction and looks about right for monthly rent (though you might want to check it) even though it is pretty poor form not letting you know ahead of time. (my impression is that you stopped working a month ago and have been living there rent free from that time, correct me if I'm wrong).


The 400,000 for your replacement seems a little odd and if the airfare/recruitment clause is not in your contract then you probably shouldn't have to pay that either.

My understanding is that the labor board won't help you unless you have been employed for more than six months but I recommend you call the ministry of employment and labor law counseling service on this number 031 345 5000.

I used them recently when my university made a mistake (ahem) regarding severance pay and they gave me all the correct information, directed me to relevant links etc and upon presentation of this information the uni fixed it up.  Luckily I didn't need to go the next step and involve the labor office.

I checked my contract. says if i quit before 6 months then "employee shall immediately pay back employer the air ticket and other expenses that the employer has incurred in the process of hiring the employee"

doesnt say anything about recruitor and there was no airfare.

 my last day working was friday the 30th...i was always working. When i first started this job i was placed in a rather smelly and old  apartment. i was told that the lease would expire three months later and then they would find me a better place. well they found me a place but it wasnt any better and it was farther from my work. i told them that i am not moving to that place and if they insist then i'll quit.

 one week later i received my termination notice. for other reasons.

Here we go again. back to 1995, the same shit that happened then is happening now. Nothing, absolutely nothing has changed in 15years. Get married to a korean woman brother, get eh F visa that's all I can tell you.

Chalk this up as experience and sugar all the hogwan mini-vans, that's what I did. I cost him at least 10million in new engines.

hmm..funny. but you know this is a public elementary school and some recruitor...i am going the legal route first. going to the labor board with documentation and a friend on tuesday..

To be honest, your pay figures look odd.When Koreans' use such language, it means that you have probably been a difficult person, in their opinion.I would suspect that you may have really caused offence to the Owner and Co workers. It seems odd they bring that up.I have never heard of that.Co workers don't usually want to be involved in such business unless offence was felt.Warned several times,correction, willingness, etc, says it all to me.Honestly, I have never heard of people having been warned so many times.Even your accommodation was mentioned.Either they aren't being truthful, or you might have been a difficult person to manage.My advice-I might leave quietly before more difficulties arise.

Can you give the name of the school so people can either:
back up the school or
have it black listed if others have had trouble at this school too.
