What are my rights when it comes to the date of my final pay

So, my contract ends on the 6th of September - But my work is saying they will not pay me my final pay until the "regular" pay day - which is the 17th...  Is this right?  Is there anything I can do to get paid earlier?  I don't want to wait around for 2 extra weeks not working, and I don't trust to leave without being paid first.

I would be happy to hear any advice - Anyone know the laws?  Or had this happen?

Thanks!

Their pay date is irrelevant- if you have completed your contract in terms of the 12 months- they pay on 6th. You should get your severance, flight and all owed ,14 days from your official end date- if you have that in your contract terms. Go to labour board asap, if you finsihed your contract honorably.

I mention expiration date because    if your visa expires you have to leave Korea unless you tell immigratation about your problem concerning pay . You should be payed salary . bonus , and have ticket in hand on your last day of work .  So its important to know when visa expires to deal with your boss .

Re: What are my rights when it comes to the date of my final pay

I've heard as well that they have 14 days to pay you.  It's normal for public schools to pay you some time after your last day.

You can stop by immigration and they will extend your visa if it expires at the same time as your contract, though I thought they were giving everyone 13 month visas as of some time ago.

You can also go to immigration and switch to a D-10 and stick around longer if you have trouble collecting your money.

Re: What are my rights when it comes to the date of my final pay

the time it takes to fight through the Labor Board, and the Board's lack of enforcement, make that almost pointless.

Look, tell your employer you plan to leave on a certain date. Ask NICELY if they can arrange an early pay-date.

If they like you they will try to help you out. If you were a constant problem, they probably won't. Rights don't really help you here.

In many countries, it's the same deal... employers can kills you with 1,000 needles if they wish, or can make life fairly smooth. It's true, some employers are simply out to screw their workers. Most aren't, and you build your life around them, or you don't.

I'd get that line deleted if I were you. I think you are in Korea, where defamation is a crime, trust me on that. They might not, but don't risk it.

Re: What are my rights when it comes to the date of my final pay

Our Visa extends long enough - its more the point that I don't want to have to pay for more rent and the daily expenses to live in Korea while I'm not even working.

We do work in a public school, and have been nothing but exemplary employees - they've now told us that they will pay us on our last day - if they find people to replace us... I have absolutely no idea what that has anything to do with it... But that's what they've told us.

I've now bought tickets to leave and am hoping for the best - I guess, the worst case - I leave my card with a friend and ask them to transfer the cash...

Thanks for all the help!

Re: What are my rights when it comes to the date of my final pay

This is normal for a public school. I got sent money after I had been home for a few weeks and got everything I was entitled to (well almost they said I hadn't paid a bill which I had but it was only a few thousand won so wasn't worth the argument). Anyway as long as it isn't an academy owned by one person that can easily disappear then I think you will be fine.

Additionally gotta agree with Chilli that the labor board get stuff sorted out fast as long as you can prove that you have been mistreated and are acting within the law.
