Immigration Sweeps- announced for upcoming year

According to what I saw in the newspapers this and last week, immigration are going to be looking for illegal workers here.  Honestly, teachers aren't usually targetted as a rule, but are not immune from these kind of checks. We'll see.

Please be careful, if you are posting ads here, earning outside of your legal contracts, or even in a nearby City  that's not your own. You never know. Perhaps just a telling off and a fine. Deportation can be a choice. The manager himself will tell you that this site is monitorred, and the odd ad placed to catch out the odd Waykook.

Check the Herald, Times, or Ilbo for confirmation. These checks will bring income for the authorties; fines for the Hakwons, parents; or Person working so,  and are a great chance to show off for them, don't be a victim of their success, and your own.

Your face is likely going to all over newspapers and TV, it could be embarassing. Sometimes, no respect for privacy here, the laws can be overlooked for foreigners at times.

Also, I'd like to point out to not tell the people you are applying to that you are looking for something under the table or illegal. I've had more than one person blatantly tell me that they are looking for what amounts to an illegal job for my job ads ("I don't want my boss to know, no contract is perfect, etc" when they don't have the correct visa). I would think this would be common sense, but apparently some newbies don't realize that they could be talking to an immigration person.

most teachers who get caught usually end up with fines.

When you about to start work, don't do anything before you visit immigration office first.

(means you have to get a visa first before doing any work. same goes with when you change your work place)

because if your contract shows that you been working before you getting a visa, you and your boss have to pay serious amount of money for that violation.

Unless laws have changed    all teachers regardless of visa status     D  , F or E   need to make a License at the education board if they want to do private teaching  or tutoring . Even Koreans need a license . The only   people are Univ students who can teach some hours a week without it .

Do you have a link to the article you read? I've been told that it's Ministry of Education that is cracking down, not immigration. If this is the case this is my understanding of the situation, although there are some areas I am not 100% sure on, so don't take it as gospel.

I am writing this in relation to working in another school or hagwon, not private tutoring at home, for that refer to Robert's previous post.

If you want to work in a second school you need the sponsor of your visa to give your permission. And then you take this permission to Immigration. It's surprising how many sponsors do give this permission!

Now, The Ministry of Education requires all schools to register all teachers. Now I'm not sure what documents are needed to register, a valid ARC obviously, but when I started at my school I had to submit a ciminial record check as well, but I've heard of others who haven't. I think it has something to do with different requirements required by different Gu offices.

From what I understand the Ministry of Education and Immigration (part of the Ministry of Justice) do not work together, do not liaise or share information. They are two separate entities. If you give your ARC to your school and they register it with the MofE this is all the MofE requires. They don't check with immigration to see if you have the permission of your sponsor. Now, I maybe wrong on this, and therefore wouldn't recommend anyone to pass over their documents to their school to be given to the MofE. Although if anyone could confirm what I've written is correct, or not, it would be appreciated.

So, if you decide to take a risk and not pass over your documents to your school and the Ministry of Education do a spot check here is where the problems begin. Your school gets fined about 5 million Won. I would presume the teacher gets fined as well, but don't know how much.

The Ministry of Education may or may not pass on their information to immigration. If you produce your ARC you might get away with just a fine, but again I don't think it's a risk worth taking and therefore wouldn't recommend it.

If they do pass on the information to immigration, immigration would then contact your school, you would be fined again, more than likely fired and could even be deported.

Someone posts something like this every year. I'm not saying it isn't true but it seems to happen around this time every year. I don't mind illegal workers taking all the crap jobs and thus stop my phone ringing for worthless crap. I find it surprising when hot young E2s are stupid enough to take business classes for 35k an hour when I as a fat old man got 60k. I mean who would the students rather see in the morning? My 2013 rates are 70k for a 1hour class, 120k for a 2 hour class, and 160k for a 3 hour class providing there is a maximum of 30 minutes travel and I still get work. Actually I reject work that isn't interesting or has low level students as well. I think that illegals should be smarter and charge more, but I don't really care.

An update to my original post. I was told yesterday by someone after they read my post that the Ministry of Education requires a valid ARC, criminal record check and your degree certificate. Now the latter may or not have to be apostile stamped depending on the area of town, some except just a copy of the certificate you give to immigration, others just the certificate, others need the original with the apostile stamp!

I   was also asked  recently by an Education Board to get a medical test .This was for a part time job . The strange thing is they say I must go to a hospital near there office . Never heard of this . I heard you must have a medical  test  and give them a medical report within 30 days of taking the test . But they said I must go to just this hospital near there offices . Usually there is a list of  hospitals you may go to .

Glad I don't work in Hagwons if you're an F5 visa holder take the Busan Education Office to the National Human Rights Commission www.humanrights.go.kr or speak to Busan Global Centre about filing a complaint with the Constitutional court as Article 6 generally makes treating permanent residents differently to Koreans a criminal offence due to Korea ratifying the UN Convention on Ending all Racial Discrimination (CERD). My Korean wife has worked in Busan Hagwons for 10 years and never been required to produce a health or police check. Xenophobic wastes of space from the sound of it.

F2 and F4 should have the same rights as F5 or Koreans in this one.  The Korean Constitution Article 6 section 2 extends protection to all aliens under CERD.

The biggest problem is what is happening isn't nnecessarily racist especially against F4s but it is highly xenophobic.  F4s are of Korean blood, but they have lived abroad so they become "tainted" in the eyes of the xenophobic.  Also discrimination against F4s allow Koreans to tell themselves they aren't racist.

While I equate xenophobia with racism whether or not the National Human Rights Commission or the Constitutional Court of Korea would is yet to be tested.
